The Court Restored the Right to Be Recognized as a Person with a Disability
The beneficiary of the “Protection of Rights Without Borders” NGO had been recognized as a person with a third-group disability since 2016 due to severe and permanent spinal and neurological health conditions.
However, in 2023, despite the absence of any improvement in the beneficiary’s health condition, the Unified Social Service of the Republic of Armenia once again refused to recognize his disability status.
The PRWB lawyer challenged this decision before the Administrative Court of the Republic of Armenia.
A forensic medical examination confirmed that the beneficiary’s health condition had not improved, and the Court concluded that the termination of his disability status was unlawful under the circumstances.
By its judgment of 15 June 2026, the Administrative Court upheld the claim, restoring the beneficiary’s violated rights and ordering the Unified Social Service to recognize him as a person with a third-group disability.
The loss of disability status is not merely a legal matter. It has a direct impact on a person’s right to social protection, access to healthcare, and the ability to live with dignity. Decisions affecting these rights must be based on objective medical evidence and made in strict compliance with the law.
