The court has upheld forcibly displaced children’s right to social support
A forcibly displaced person from Artsakh applied to the Protection of Rights without Borders (PRWB) NGO to seek protection of her three minor children’s right to social support. Their interests were represented by PRWB lawyers Nina Hakobyan and Tatevik Siradeghyan.
Beginning in January 2024, the social support payments intended for the children were only partially disbursed on the grounds that their father owned real estate.
In its judgment of December 10, 2025, the Administrative Court upheld the claim. The Unified Social Service subsequently appealed the judgment; however, the Administrative Court of Appeal rejected the appeal in its decision of August 26, 2026, leaving the original judgment unchanged.
In its decision, the Administrative Court of Appeal established an important legal position, emphasizing that the mere fact that the children’s father owns real estate is not, in itself, a decisive factor in determining their eligibility for social support. The evidence in the case did not establish that the father lived with the children, shared a household with them, or qualified as a member of their family within the meaning of the Republic of Armenia’s Law on Social Assistance.
This decision is significant not only for restoring the children’s violated rights but also for promoting consistent legal practice among administrative bodies and courts in similar cases.
