The decision of the Investigator on the rejection of the insituting of a criminal case regarding the hinderence of monitoring being conducted in penitentiary institutions was appealed in judicial order

Hasmik Harutyunyan, the legal expert of the Protection of Rights without Borders NGO applied to the Court of General Jurisdiction of Arabkir and Kanaker Zeytun Administrative Districts on the demand to eliminate the decisions made on the institution of a criminal case by the RA Special Investigation Service, as well as to eliminate the human rights violations.

It should be mentioned, that the professional activities of Arman Sahakyan, employee of “New Generation” Humanitarian NGO and Hasmik Harutyunyan, employee of the Protection of Rights without Borders NGO as members of the Public Oversight Group Conducting Control over Penitentiary Institutions were hindered in “Nubarashen” and “Kentron” penitentiary institutions on April 2 of 2017.

On April 3 of 2017, a report on instituting a criminal case by Helsinki Citizens’ Assembly Vanadzor Office was filed to the RA Special Investigation Service on the grounds that the member of the Public Oversight Group Conducting Control over Penitentiary Institutions Arman Sahakyan and Hasmik Harutyunyan were prohibited to enter “Nubarashen” and “Kentron” penitentiary institutions. The RA Special Investigation Service, however, made a decision on the rejection of the criminal case on the grounds of the absence of crime.

On April 25 of 2017, Hasmik Harutyunyan filed a complaint to the Prosecutor General’s Office  against the decision made by the RA Special Investigation Service, considering that an effective examination of the case had not been conducted. A decision on the rejection of the complaint, regarding the insitution of a criminal case submitted by investigator, was made by the Prosecutor General’s Office.

The complaint-application was submitted as a prceeding by the Court of General Jurisdiction of Arabkir and Kanaker Zeytun Administrative Districts. The court session for August 1 of 2017 has been delayed: the next court session will take place on September 2 at 17:00 PM.
