European Court of Human Rights addressed questions to the RA Government in regard to “Nikolyan v. Armenia” case
On November 17, 2016 the European Court of Human Rights communicated the “Nikolyan v. Armenia” complaint. The case was submitted to the European of Court of Human Rights by the “Protection of Rights without Borders” on November 13, 2014. The issue of the violation of the Articles 6 and 8 of the European Convention on Human Rights was raised in the complaint-application. Particularly, under Article 6.1 of the Convention, the applicant raised an issue, that the trial on his disability at the First Instance Court of General Jurisdiction of Shengavit Administrative District was not competitive, besides the applicant was denied access to the court, as well as the opportunity to restore his capacities.
Under Article 8 of the Convention, the applicant raised the issue that the deprivation of his capacities violated his right to respect for private and family life.
