The Response of the RA Ministry of Justice and the RA Judicial Department to the Observations Made on the Highest Judicial Council’s Activities by the PRWB

By the letters dated June 19 of 2018, the RA Ministry of Justice and RA Judicial Department respectively responded to the information note elaborated by the Protection of Rights without Borders NGO in regard to the observation outcomes on the implementation of the functions of appointing judges by the Highest Judicial Council.

In response the RA Ministry of Justice mentioned, that a procedure directed towards the changes of the secret voting procedure for the purpose of submitting a recommendation on the candidates of judges in accordance with the respective RA constitution law conducted in the Highest Judicial Council has been initiated.

It should be mentioned, that the information note was addressed to the Highest Judicial Council, but its response was submitted by the RA Judicial Department. Particularly, by the response letter Judicial Department expressed its disagreement on the observations made in the information note.

According to Judicial Department, the observation outcomes on the implementation of the functions of appointing judges by the Highest Judicial Council presented by the Organization do not reflect the reality of current legislative regulations.

It should be mentioned, that the observations and concerns on the appointment procedure of judges by the Highest Judicial Council are presented in the information note elaborated by the Organization.
