Summary of the observation results of the election of candidate for the chairman of the Anti-Corruption Committee
On January 20, 2025, the interview stage of the competition
V. Teymurazyan has been convicted and at the same time been justified by the RA authorities for three times. In the outcomes of the criminal proceedings against him, however, Teymurazyan lost his job and apartment.
On March 23 of 2009, a complaint-application was submitted to the European Court of Human Rights in regard to the violated rights of V. Teymurazyan. The application was submitted to the European of Court of Human Rights by the lawyers of the “Protection of Rights without Borders” NGO. An issue under Article 6 of the European Convention on Human Rights was raised in the application on the grounds that the applicant was deprived of the right to access the court, and the court decisions made in this regard were unjustified.
In his application, the applicant raised the issue of the violation of Article 3 of the Convention. In accordance with above mentioned Article, no one shall be subjected to torture or to inhuman or degrading treatment or punishment. V. Teymurazyan was subjected to beating and ill-treatment by traffic policemen in the presence of his juvenile son, which had irreparable consequences both on his son and family.
At the same time, Article 5.5 of the Convention is also considered to be violated under the case, according to which everyone who has been the victim of arrest or detention shall have an enforceable right to compensation. It is undeniable under this case that Teymurazyan has been arrested and justified for 3 times, meanwhile, his complaint-applications in regard to obtaining compensation or restoring his violated rights have not been thoroughly satisfied by the Court.
The issue of the violation of Article 1 of Protocol 1 of the Convention was also raised, which guarantees the right to the property/peaceful enjoyment of property. As stated by Teymurazyan, during his detention the respective authorities had an intervention in the apartment by him, as a result of which he lost his apartment.
The European Court of Human Rights communicated the current case to the Government of the Republic of Armenia on November 17, 2011 and March 23 of 2017 respectively.
