“Why Are There No Armenians In Nagorno-Karabakh?” fact-finding report was
The case (number 12381/16) of Marina Poghosyan, the President of the “Veles” NGO submitted to the European Court of Human Rights by the “Protection of Rights without Borders” NGO (lawyer Haykuhi Harutyunyan) has been communicated.
The Court has submitted the questions regarding the violation of right of the person to the RA Government. Particularly, the Court has asked the parties to clarify whether Marina Poghosyan has been subjected to the inhumane, degrading treatment and whether the examination (investigation) for the violation against her was effective.
It should be highlighted, that this is one of the rarest cases, when the violation against the human rights defender during his/her professional activities in Armenia became an issue of investigation by the European Court of Human Rights.
The Government of the Republic of Armenia should be able to justify, that the fact of subjecting the human rights defender to oppression and humiliation in front of her client has been properly and effectively investigated. In her application, the applicant touched upon the issue, that organizations and individuals involved in the human rights protection in Armenia are often subjected to violence, pressures, which leads to common fear and distrustful atmosphere in public.
After the confirmation of the violation by the European Court of Human Rights, the State will be obliged to take effective measures directed towards the protection of human rights defender’s rights.
