VOLODYA AVETISYAN DEMANDS EARLY CONDITIONAL RELEASE

Volodya Avetisyan, who has been sentenced for 6 times, announced today at the court, that he was sentenced by the law and can be released under the early conditional release of the same law too.

“I wish the law was exercised in our country, Mr. Judge. If the law is exercised, it should be for everybody; we become a strong and powerful country in the world. There is only one problem here: justice and rule of law to have good and strong country for our future generation. For example me and other prisoners think, that since the day we submit our application of early conditional release to the penitentiary institution and the latter is refused, we become captives, not prisoners since that day” – announced Avetisyan at the court.

The reserve colonel and his advocate Araks Melkonyan applied to court with a request to release the freedom fighter under early conditional release. Advocate Araks Melkonyan clarified at the court that the law provides them with such opportunity. “In our country, the court is the only body to make that decision; approval or disapproval of the independent commission, in this case should not have any kind of importance” – mentioned the advocate.

According to the last amnesty, Avetisyan who was sentenced to six-year imprisonment on September 13 of 2014 can be released in one month. It should be noted, that the desire and motive of early release from prison made Avetisyan apply to the court.

While presenting the prisoner at Vardashen penitentiary, the  advocate mentioned that the latter had positive characteristics and a good conduct, due to which the head staff of the penitentiary applied to the independent commission for six times to provide Avetisyan early conditional release.  According to the statement of the advocate, the Commission rejected all the applications without justification. “I received a letter stating that the appeals were rejected but I cannot understand why. Such decision should be justified and well-grounded decision to be presented to the prisoner, so that the latter understood his conduct during the imprisonment” – mentioned the advocate.

Judge Artush Gabrielyan referred to the remark of the advocate, saying “when such an answer is given, the court invites and says, my friend when you write disapprove, you bring this word from your home, where did you find that word from? Now tell me, what do you mean by saying disapprove: maybe the guy was not shaved, his hair was not cut, and the tie was not tied, that is why his appeals were rejected”.

Ashot Hakobyan, representative of the penitentiary institution confirmed that Volodya Avetisyan demonstrated good conduct in prison: we wrote a relevant description of characteristics for his serving of sentence”.

Prosecutor Garegin Mirzakhanyan, while urging the judge to reject the appeal of Avetisyan, said that Avetisyan should have applied to the Independent Commission which rejected him for 6 times; “We have a commission entitled as independent, since it’s not connected to any other bodies. I highlight, that our legislation does not provide such opportunity. That is why I intervene the application on early conditional release to be rejected, since the prescribed orders are not preserved, there is a negative conclusion”, – said the prosecutor.

Volodya Avetisyan announced today at the court, that as prescribes by the order, 5.000 AMD is daily spent on each prisoner, meanwhile such amount of money was never spent on him; “I have not seen it that is why I claim that it’s a high risk corruption, a relevant commission should be created in this regard to conduct the relevant inspections”.

Volodya Avetisyan was prisoned a few years ago after carrying out demonstration on the demand to improve the social conditions of soldiers. As state by him, the authorities “with a fake criminal case imposed on him” tried to isolate him. The freedom fighter was recognized guilty on the grounds of fraud and attempts of fraud.

The court will make a decision on the request of early conditional release for Volodya Avetisyan on April 14 of 2017.
