The Prosecutor General’s Office Rejected the Appeal Filed against the Discontinuation of the Criminal Case Instituted in Regard to the Citizens who Suffered the Ill Treatment of the Police During the April Events of 2018 in Armenia
By the decision of the Prosecutor General’s Office dated August 23 of 2019, the appeal filed against the decision of the Special Investigation Service to discontinue the proceeding of the criminal cases number 62212818 instituted against the citizens who suffered the ill treatment of the police during the protests taking place in the Republic of Armenia during April 16-23 of 2018 was rejected.
The decision on the discontinuation of the criminal cases was appealed for the second time on August 20 of 2019 by the advocated of the “Protection of Rights without Borders” NGO, who were the representatives of the given case.
The Prosecutor General’s Office justified its decision by the same fact, that all the necessary investigative, other judicial activities were carried out by the given criminal case, operative-investigative measures were taken, as a result of which, sufficient evidence was not obtained on accusation of a person into a publically dangerous dead: it was impossible to detect those persons, who should have been involved in the criminal cases as accused, therefore, the investigator made a legal, conditioned decision and there are no grounds to eliminate the latter.
The first decision on the elimination of the criminal case instituted by the Special Investigation Service was appealed by the Organization to the Prosecutor General’s Office on November 16 of 2018.
On April 29 of 2019, the Prosecutor General’s Office made a decision to reject the appeal.
On May 29 of 2019, the Organization advocates appealed the decision of the Prosecutor General’s Office in a judicial order.
On July 12 of 2019, during the court hearing of the judicial examination, the RA Special Investigation Service made a decision to restarted the proceeding of the discontinued criminal case.
But till the court would have made a final decision on the appeal, the body in charge of conducting the proceeding discontinued the proceeding of the criminal case for the second time.
The Organization advocates will appeal the decision of the Prosecutor General’s Office to the court.
