HAYKUHI HARUTYUNYAN AGAINST RA POLICE ON THE RECOGNITION OF THE POLICE ACTIVITIES ILLEGAL

Haykuhi Harutyunyan, the President of the “Protection of Rights without Borders” NGO applied to the RA Administrative Court of Appeal to appeal the decision N ՎԴ/1043/05/16 made by the Administrative Court on the grounds of violating the substantive and procedural norms on May 4 of 2017.

By the decision of the Administrative Court, the claim of Haykuhi Harutyunyan against the RA Police was rejected. According to the Court, the claim of the plaintiff in regard that in the given situation an unlawful interference with his right to the freedom of movement was sufficient. According to the Court’s conviction, the applied sanctions were conditioned: in this case the illegal interference with the freedom of expression, freedom of speech, the right of the plaintiff to refrain from discrimination was not displayed by the policemen.

It should be mentioned, that on January 21, the President of the Protection of Rights without Border NGO noticed from the public transport 12 policemen and four parents of the soldiers, who passed away in peaceful conditions, standing at the entrance of the RA Presidential Palace. Haykuhi Harutyunyan approached the parents of the soldiers: after a while, approximately 10-12 policemen blocked H. Harutyunyan removing her from her standing position and prohibited her moving to public area.

In response to the claim of H. Harutyunyan to let her go the police laughed and continued mockingly moving towards her.

The policemen did not warn H. Harutyunyan about the use of force, did not give any explanation in regard of which of her actions gave them a ground to use force against her and remove her from the area and did not give any legal justification in this regard too.

The Organization issued a statement and sent the relevant letters to the Special Investigation Service and the RA Police with the demand to record the violations, give the latter legal assessment, as well as bring the offenders to responsibility.

The Organization has submitted a complaint-application to the RA Administrative Court requesting the latter to recognize the police activities illegal, which were displayed including in the form of the violation of the rights to freedom of expression of the plaintiff, the right to freedom of speech, the right to the freedom of association, as well as refraining from the inhuman or degrading, discriminative treatment.
