Statement by a Group of Civil Society Organizations on the Strategic Partnership between Armenia and the USA

THE ECHR HAS REGISTERED THE COMPLAINT ON THE REJECTION OF THE EARLY CONDITIONAL RELEASE OF THE CONVICTED
The European Court of Human Right has registered the Nazaryan v. Armenia complaint.
In the complaint, the issues related to the early conditional release before the serving the sentence in Armenia and in this regard the issue of the violation of right to freedom of H. N. were raised before the ECHR.
The issue of the early conditional release of the convicted H.N. has been raised also in the domestic courts of Armenia. Failing on the domestic level, a complaint on the grounds of the violation of the right to freedom under Article 5 of the Convention was filed to the ECHR by the lawyers of the “Protection of Rights without Borders” NGO.
It was particularly mentioned in the complaint, that the Republic of Armenia lacks the objective criteria and effective mechanism regarding the early conditional release of the convicted, which would enable to objectively and individually evaluate the necessity for the further serving of the sentence. The lack of such mechanism leads to unjustified and non-personalized decision making both by the Independent Committee and courts involved in the process, by violating the right of the convicted to freedom.
