Statement by a Group of Civil Society Organizations on the Strategic Partnership between Armenia and the USA

The Protection of Rights without Border NGO informs that by the demand of the legal representative and against his will the citizen G. N. was illegally taken to the “Nubarashen” psychiatric medical center on July 8 of 2017. By the violation of the national legislation, G. N. was recognized incapable in 2013.
The decision made by the RA national bodies on recognizing the citizen as incapable was made on the grounds of the application of his wife, when the citizen wanted to divorce and expelled his wife from his home. In fact, the domestic courts, neglecting the absence of the citizen’s mental health problems, considered the application submitted by his wife and recognized the citizen as incapable violating his rights as enshrined by the Constitution and other international documents.
The recovery process of the citizen’s functionality is ongoing which had negative effects on the sick and old man with its complexity, length and procedural violations. In the outcomes of the trial to change the legal representative of G. N. in 2016, the RA Court of Cassation accepted that taking into consideration the tense and conflict relationships between N. G. and his son, the decision on appointing a guardian needs to be reviewed. Nevertheless, the guardian of N. G. is still his son.
On July 8 of 2017, the son of G.N., who is his guardian, against the will of G.N moved the latter to “Nubarashen” psychiatric hospital trying to isolate his father.
We inform that G. N. is illegally kept in psychiatric institution, under the conditions of which a number of rights of the citizen are violated.
The Organization will pursue the recognition and restoration of the violated rights of its beneficiary, as well as will bring to liability the respective competent authorities in this regard.
