On\nMay 7 of 2020, the European Court of Human Rights published the verdict on murder\ncase of soldier Arayik Avetisyan. <\/p>\n\n\n\n
The\nson of the Applicant Anahit Mkrtchyan, the 22 year-old soldier Arayik Avetisyan\nwas killed on October 30 of 2001 as a result of getting a deadly injury on the\nhead in the office room of the commander.<\/p>\n\n\n\n
According\nto official version, there were four other soldiers with Arayik Avetisyan\nduring his death and the fatal gunshot was caused by the fellow soldier as a\nresult of the latter\u2019s negligent attitude with the commander\u2019s weapon. Although,\nthe accused soldier completely accepted his guilt, as a result of the obtained\ncontradictory facts, including also, based on the evidence of the witnesses and\nthe contradictory conclusions issued by the experts, the domestic courts\nforwarded the case to a new examination for two times. <\/p>\n\n\n\n
On\nFebruary of 2010, as a result of the lack of evidence, the criminal prosecution\nagainst the accused was ceased and the proceeding of the criminal case was\nsuspended. <\/p>\n\n\n\n
The\ninterests of Anahit Mkrtchyan were represented at the European Court of Human\nRights by the advocates of \u201cProtection of Rights without Borders\u201d NGO. <\/p>\n\n\n\n
The\nviolation of Articles 2 and Article 13 respectively, protected by the\nConvention, was raised by the complaint-application filed to the European Court\nof Human Rights dated January 10 of 2011, since efficient investigation in\nregard to the death case of Arayik Avetisyan was not conducted by the domestic\nbodies, not being able to detect the essential circumstances of the death and\nthe person who committed the crime.<\/p>\n\n\n\n
By\nthe verdict made on Anahit Mkrtchyan v. Armenia case, the European Court of\nHuman Rights detected, that the Republic of Armenia violated the obligation to\nconduct effective investigation on the murder case of Arayik Avetisyan,\nparticularly: <\/p>\n\n\n\n
\u2022 By the still ongoing investigation the\nweapon by which the murder was committed, as well as the reason of the injuries\ncaused not by the weapon have not been detected.<\/p>\n\n\n\n
\u2022 The body in charge of conducting the\nproceeding, easily accepted and conducted an investigation only for one\nversion, in case, when the witness presented an evidence completely denying the\nversion and presenting information about another person, who allegedly\ncommitted the murder, but the investigation conducted in regard to the checking\nof the presented data was not proper. Moreover, the denial of the evidence\npresented by the same witness was easily accepted, without checking the\npossibilities of fear and pressure applied against the latter, even after the\ncase, when the main suspect announced that he\/she accepted the guilt taking\ninto consideration the safety of their own family. <\/p>\n\n\n\n
\u2022 The Court recorded that for two times, the case was forwarded from the domestic courts to a new investigation, which clearly points out the serious gaps in the Republic of Armenia judiciary. <\/p>\n\n\n\n
The\ninvestigation of the criminal case in regard to the death of Arayik Avetisyan\nis still ongoing, but the proceeding of the case was suspended in March of 2019\nfor the second time on the ground of the alleged suspect involved in the\ncriminal case being unanimous. <\/p>\n\n\n\n
For the recorded\nviolations, the European Court of Human Rights obliged the Republic of Armenia\nto pay a compensation for moral damage in the amount of 24000 Euros to the\nApplicant. <\/p>\n\n\n","protected":false},"excerpt":{"rendered":"
