{"id":30973,"date":"2020-04-04T12:56:00","date_gmt":"2020-04-04T08:56:00","guid":{"rendered":"http:\/\/prwb.am\/2020\/04\/04\/%d5%a1%d5%a6%d5%a3%d5%a1%d5%b5%d5%ab%d5%b6-%d5%aa%d5%b8%d5%b2%d5%b8%d5%be%d5%ab-%d5%a1%d5%b6%d5%a3%d5%b8%d6%80%d5%ae%d5%b8%d6%82%d5%a9%d5%b5%d5%b8%d6%82%d5%b6%d5%a8-%d5%b4%d5%a1%d6%80%d5%a4%d5%b8\/"},"modified":"2022-12-05T10:56:01","modified_gmt":"2022-12-05T06:56:01","slug":"%d5%a1%d5%a6%d5%a3%d5%a1%d5%b5%d5%ab%d5%b6-%d5%aa%d5%b8%d5%b2%d5%b8%d5%be%d5%ab-%d5%a1%d5%b6%d5%a3%d5%b8%d6%80%d5%ae%d5%b8%d6%82%d5%a9%d5%b5%d5%b8%d6%82%d5%b6%d5%a8-%d5%b4%d5%a1%d6%80%d5%a4%d5%b8","status":"publish","type":"post","link":"https:\/\/prwb.am\/en\/2020\/04\/04\/%d5%a1%d5%a6%d5%a3%d5%a1%d5%b5%d5%ab%d5%b6-%d5%aa%d5%b8%d5%b2%d5%b8%d5%be%d5%ab-%d5%a1%d5%b6%d5%a3%d5%b8%d6%80%d5%ae%d5%b8%d6%82%d5%a9%d5%b5%d5%b8%d6%82%d5%b6%d5%a8-%d5%b4%d5%a1%d6%80%d5%a4%d5%b8\/","title":{"rendered":"The Inaction of the National Assembly in Addressing the Gross Human Rights Violation"},"content":{"rendered":"\n<p>Back on November 1 of 2019, the advocates of the Protection of Rights without Borders NGO filed an application to the President of the RA National Assembly, to all the fractions, to the RA National Assembly Standing Committee on Protection of Human Rights and Public Affairs, to the RA National Assembly Standing Committee on State and Legal Affairs recommending to organize parliamentary hearing on the gross human rights violations which took place in the Republic of Armenia on June 23 of <a href=\"https:\/\/prwb.am\/2019\/11\/06\/electric-yerevan\/\">2015<\/a>, July 17-30 <a href=\"https:\/\/prwb.am\/2019\/11\/12\/sari-tagh-2016\/\">2016<\/a> and April 16-23 of <a href=\"https:\/\/prwb.am\/hy\/2019\/11\/12\/velvet-revolution-april-2018\/\">2018<\/a> respectively and to provide possible effective protection measures to the citizens, whose rights were violated during the above mentioned events. <\/p>\n\n\n\n<p>Both before and after the Velvet\nRevolution of 2018, the issue related to violations of the fundamental rights\nwere raised in all domestic and international platforms by the employees of the\nOrganization and by which the possible mechanisms for restoring the violated\nrights were demanded. <\/p>\n\n\n\n<p>The applying to the National\nAssembly and recommendation to conduct parliamentary hearings on the violations\ntaking place during the peaceful assemblies pursued an objective to make the\nissue of gross human rights violations during many years and its policy a\nmatter of discussion, as well as address the bodies involved in the carrying\nout investigation, including RA Police, investigative bodies, courts. <\/p>\n\n\n\n<p><strong>Nevertheless, no measure in regard to the activities\nrecommended by the application addressed to the relevant bodies of the National\nAssembly was carried and the Standing Committee on State and Legal Affairs\nreplied to the application my mentioning that the Committee accepted the\napplication. <\/strong><strong><\/strong><\/p>\n\n\n\n<p>By the RA Constitution and the RA\nConstitutional Law \u201cOn Rules of Procedure of the National Assembly\u201d, the RA\nNational Assembly is vested with the authority to organize parliamentary\nhearing on the topics of public concern, among other issues. This is an\nadditional possibility to make an issues of public interest be heard and detect\nthe measures of more efficient protection. <\/p>\n\n\n\n<p>Moreover, the RA National Assembly\nwith its functions and status carries a special role both separately and in the\ncontext of the relations with other state bodies. Therefore, in case of the\nissue presented by the application may become a matter of discussion in the RA\nNational Assembly, the latter would have become a matter of discussion by the\nlaw enforcement bodies in terms of finding an objective solution.<\/p>\n\n\n\n<p>The lawyers of the Organization raised this issue,\nthat the body in charge of carrying out the proceeding by the&nbsp; above mentioned cases have not conducted an\nefficient examination and in this regard the solutions of these problems are\nexpected to get from political bodies. <\/p>\n\n\n\n<p><strong>Nevertheless, the issue of the gross human rights\nviolations has received neither legal, nor political evaluation, no reconciliation\nwas initiated with the victims, the implementation of human rights obligations\nhave not been ensured and no compensation has been provided. <\/strong><\/p>\n\n\n\n<p>By the above mentioned case in scope of each above\nmentioned instituted criminal case, the body in charge of conducting the\npreliminary investigation has made a decision to discontinue the cases. <\/p>\n\n\n\n<p>The activities of the body in charge of conducing the\nproceeding were appealed by the advocates of the Organization in superior, then\nin judicial order respectively. <\/p>\n\n\n\n<p>On January 31 of 2020, the\nadvocates of the Organization filed an application to the RA Administrative Court against the RA National Assembly presented by\nArarat Mirzoyan, the President of the National Assembly, with the demand to\ninitiate parliamentary hearing on the gross human rights violations which took\nplace in the Republic of Armenia in 2015, 2016 and 2018 respectively and to\nprovide possible effective protection measures to the citizens, whose rights\nwere violated during the above mentioned events. <\/p>\n\n\n\n<p>RA\nAdministrative Court rejected the acceptance of the appeal, considering that\nthe President of the RA National Assembly is not an administrative body and the\ninitiation of parliamentary hearing by the President of the RA National\nAssembly is not an administration. <\/p>\n\n\n\n<p>The\ndecision of the RA Administrative Court was appeal to the RA Court of\nCassation, but the latter rejected the presented appeal by remaining the\ndecision of the RA Administrative Court unchanged. <\/p>\n\n\n\n<p><em>On April 20 of 2020, an appeal by the employees of the\nOrganization was filed to the RA Court of Cassation. <\/em><em><\/em><\/p>\n\n\n","protected":false},"excerpt":{"rendered":"<p>Back on November 1 of 2019, the advocates of the Protection of Rights without Borders NGO filed an application to the President of the RA National Assembly, to all the fractions, to the RA National Assembly Standing Committee on Protection of Human Rights and Public Affairs, to the RA National Assembly Standing Committee on State [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":40129,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[29,42,74],"tags":[],"acf":[],"_links":{"self":[{"href":"https:\/\/prwb.am\/en\/wp-json\/wp\/v2\/posts\/30973"}],"collection":[{"href":"https:\/\/prwb.am\/en\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/prwb.am\/en\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/prwb.am\/en\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/prwb.am\/en\/wp-json\/wp\/v2\/comments?post=30973"}],"version-history":[{"count":2,"href":"https:\/\/prwb.am\/en\/wp-json\/wp\/v2\/posts\/30973\/revisions"}],"predecessor-version":[{"id":34157,"href":"https:\/\/prwb.am\/en\/wp-json\/wp\/v2\/posts\/30973\/revisions\/34157"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/prwb.am\/en\/wp-json\/wp\/v2\/media\/40129"}],"wp:attachment":[{"href":"https:\/\/prwb.am\/en\/wp-json\/wp\/v2\/media?parent=30973"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/prwb.am\/en\/wp-json\/wp\/v2\/categories?post=30973"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/prwb.am\/en\/wp-json\/wp\/v2\/tags?post=30973"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
