Armenia&#8221; Case"},"content":{"rendered":"\n<p>The Council of Europe\nCommittee of Ministers published the decision on \u201cMushegh Saghatelyan v.\nArmenia\u201d case on June 4 of 2020. <\/p>\n\n\n\n<p>The observations on the case presented by the Open Society Foundations \u2013 Armenia, Protection of Rights without Borders NGO, Transparency International Anti-Corruption Center, Helsinki Citizens&#8217; Assembly-Vanadzor Office and Law Development and Protection Foundations, as well as the responses of the Government were <a href=\"https:\/\/hudoc.exec.coe.int\/eng#{%22EXECIdentifier%22:[%22DH-DD(2020)401E%22]}\">published<\/a>. <\/p>\n\n\n\n<p>The observations were\npresented in accordance with the Rule number 9.2 prescribed by the CoE\nCommittee of Ministers. The case related to the events of March 1, 2008. <\/p>\n\n\n\n<p>The ministers proved\nthat a number of Articles, particularly Articles 3, 5, 6, 11 and 13\nrespectively of the European Conventions of Human Rights were violated by the\nSaghatelyan case. <\/p>\n\n\n\n<p>By the decision, the\nCommittee of Ministers referred also to the following: <\/p>\n\n\n\n<ul>\n<li>the constitutional and legislative\nchanges in the field of combatting ill-treatment and investigations into such\nallegations, called on the authorities to adopt the draft laws intended to\nentrench positive changes in the legal framework without further delay, and\nrecommend them to provide information on the implementation of the adopted\nlaws, <\/li>\n\n\n\n<li>Gradual establishment of the audio and\nvideo surveillance equipment in the RA Police premises and recommend the\nauthorities to clarify their use and particularly whether the law enforcement\nbodies are obliged to use the audio and video recordings during interrogations\nas evidence;<\/li>\n<\/ul>\n\n\n\n<p>The Council of Europe Committee of\nMinisters urged the RA authorities to take measures directed towards the\napproval of the draft criminal procedural code and to avoid its further\npossible delays, so that the practice of the RA Prosecutor General\u2019s Office and\njudicial bodies respectively are in a compliance of the Convention\nrequirements. <\/p>\n\n\n\n<p class=\"has-vivid-cyan-blue-color has-text-color\"><a href=\"https:\/\/search.coe.int\/cm\/Pages\/result_details.aspx?ObjectID=09000016809e7a9d\"><strong>The Decision of the CoE Committee of Ministers. <\/strong><\/a><\/p>\n\n\n","protected":false},"excerpt":{"rendered":"<p>The Council of Europe Committee of Ministers published the decision on \u201cMushegh Saghatelyan v.
