{"id":30953,"date":"2020-06-03T08:12:00","date_gmt":"2020-06-03T04:12:00","guid":{"rendered":"http:\/\/prwb.am\/2020\/06\/03\/%d5%a4%d5%a1%d5%bf%d5%a1%d5%be%d5%a1%d6%80%d5%b8%d6%82%d5%a9%d5%b5%d5%b8%d6%82%d5%b6%d5%b6%d5%a5%d6%80-%d5%b8%d6%82%d5%b2%d5%b2%d5%be%d5%a1%d5%ae-%d5%a2%d5%a1%d5%b6%d5%af%d5%a5%d6%80%d5%ab-%d5%af\/"},"modified":"2022-12-05T10:53:02","modified_gmt":"2022-12-05T06:53:02","slug":"%d5%a4%d5%a1%d5%bf%d5%a1%d5%be%d5%a1%d6%80%d5%b8%d6%82%d5%a9%d5%b5%d5%b8%d6%82%d5%b6%d5%b6%d5%a5%d6%80-%d5%b8%d6%82%d5%b2%d5%b2%d5%be%d5%a1%d5%ae-%d5%a2%d5%a1%d5%b6%d5%af%d5%a5%d6%80%d5%ab-%d5%af","status":"publish","type":"post","link":"https:\/\/prwb.am\/en\/2020\/06\/03\/%d5%a4%d5%a1%d5%bf%d5%a1%d5%be%d5%a1%d6%80%d5%b8%d6%82%d5%a9%d5%b5%d5%b8%d6%82%d5%b6%d5%b6%d5%a5%d6%80-%d5%b8%d6%82%d5%b2%d5%b2%d5%be%d5%a1%d5%ae-%d5%a2%d5%a1%d5%b6%d5%af%d5%a5%d6%80%d5%ab-%d5%af\/","title":{"rendered":"Trials on the Exclusion of Discrimination Demonstrated by the Banks"},"content":{"rendered":"\n<p>In\nDecember of 2019, on behalf of 4 physical entities the lawyers of the\nProtection of Rights without Borders NGO filed appeals to the Yerevan Court of\nGeneral Jurisdiction against the banks operating in the Republic of Armenia with\nthe demand to recognize the applied discrimination fact and compensate the\nmoral damages. <\/p>\n\n\n\n<p>The\napplicants were citizens of the Republic of Armenia and Islamic Republic of\nIran respectively, who had applied to \u201cAmeriabank\u201d CJSC, \u201cAcba-Credit Acricole\nBank\u201d CJSC, \u201cConverse Bank\u201d CJSC&nbsp;\nrespectively in order to receive banking services (opening of foreign\ncurrency account and card provision, making transfers in foreign currencies\nfrom account, etc.). <\/p>\n\n\n\n<p>The\nbanks rejected to provide the relevant services, taking into account the ground\nthat the latter were citizens of Islamic Republic of Iran and mentioning that\nthe restriction in regard to the citizenship of Islamic Republic of Iran was\napplied in a line with the relevant internal legislative acts of the bank. <\/p>\n\n\n\n<p>In\nsuch conditions, the Republic of Armenia banks ignored the rights of the\ncitizens who were born in the Islamic Republic of Iran with Iranian and\nArmenian citizenship by subjecting the latter to discrimination violating their\nright to getting banking services in equal conditions with other citizens.<\/p>\n\n\n\n<p>On\nJune 11 of 2020, the initial judicial sitting on the two cases of the applicant\nagainst \u201cAmeriabank\u201d CJSC was held, during which the representatives of the\napplicant presented the grounds and demands of the appeal. <\/p>\n\n\n\n<p>The\ncourt discussed the issue to unite the two cases, as well as the respondent was\ngiven time to present written observations. <\/p>\n\n\n\n<p>The\nfollowing demands were put on the basis of the presented appeals presented by\nthe lawyers of the PRWB NGO: <\/p>\n\n\n\n<ul>\n<li>Recognize, that the rejection to provide\nbanking services by the Armenian banks was conditioned by discrimination on\ncitizenship grounds against the applicants <\/li>\n\n\n\n<li>Restore the previous situation before\nthe violation of the rights by obliging the respondent banks to provide the\nrelevant services, <\/li>\n\n\n\n<li>Provide non-material (moral) damage\ncompensation as a result of being subjected to discrimination. <\/li>\n<\/ul>\n\n\n","protected":false},"excerpt":{"rendered":"<p>In December of 2019, on behalf of 4 physical entities the lawyers of the Protection of Rights without Borders NGO filed appeals to the Yerevan Court of General Jurisdiction against the banks operating in the Republic of Armenia with the demand to recognize the applied discrimination fact and compensate the moral damages.
