{"id":30946,"date":"2020-06-11T09:01:00","date_gmt":"2020-06-11T05:01:00","guid":{"rendered":"http:\/\/prwb.am\/2020\/06\/11\/%d5%ab%d5%ba%d5%a1%d5%bd-%d5%a8-%d5%a2%d5%b8%d5%b2%d5%b8%d6%84%d5%a1%d6%80%d5%af%d5%a5%d5%ac-%d5%a7-%d5%a2%d5%a4%d5%ad-%d5%b4%d6%80%d6%81%d5%b8%d6%82%d5%a9%d5%a1%d5%b5%d5%ab%d5%b6-%d5%b0%d5%a1%d5%b6\/"},"modified":"2022-12-05T10:52:26","modified_gmt":"2022-12-05T06:52:26","slug":"%d5%ab%d5%ba%d5%a1%d5%bd-%d5%a8-%d5%a2%d5%b8%d5%b2%d5%b8%d6%84%d5%a1%d6%80%d5%af%d5%a5%d5%ac-%d5%a7-%d5%a2%d5%a4%d5%ad-%d5%b4%d6%80%d6%81%d5%b8%d6%82%d5%a9%d5%a1%d5%b5%d5%ab%d5%b6-%d5%b0%d5%a1%d5%b6","status":"publish","type":"post","link":"https:\/\/prwb.am\/en\/2020\/06\/11\/%d5%ab%d5%ba%d5%a1%d5%bd-%d5%a8-%d5%a2%d5%b8%d5%b2%d5%b8%d6%84%d5%a1%d6%80%d5%af%d5%a5%d5%ac-%d5%a7-%d5%a2%d5%a4%d5%ad-%d5%b4%d6%80%d6%81%d5%b8%d6%82%d5%a9%d5%a1%d5%b5%d5%ab%d5%b6-%d5%b0%d5%a1%d5%b6\/","title":{"rendered":"The PRWB Appealed the SJC Competition Committee Decree on the Decision to Reject the Presentation of Organization\u2019s Representative\u2019s Candidacy to the General Assembly of Judges"},"content":{"rendered":"\n<p>On\nJune 18 of 2020, information on announcing a competition to engage candidates\nfor the position of the non-judge member for the Ethics and Disciplinary\nCommission of the General Assembly of Judges was published at the official\nwebpage of the RA Judicial Department. <\/p>\n\n\n\n<p>The\nOrganization, having long-term experience in conducting monitoring in the\njudiciary field, evaluation of the judiciary, as well as in the related reform\nprograms, filed an application to the Competition Committee to present the\ncandidacy of Hasmik Harutyunyan, the legal expert of the Organization in the\nrelevant position. <\/p>\n\n\n\n<p>The\nCommittee adopted a decision on July 1 of 2020 to return the application and the\nattached documents filed by the Organization for the purpose to correct the related\ngaps in the document. <\/p>\n\n\n\n<p>It\nwas mentioned in the justification that the document presented by the\nOrganization is not in compliance with the requirements prescribed by the RA\nLaw on \u201cNotary\u201d. <\/p>\n\n\n\n<p>On\nJuly 3 of 2020, the President of the Organization submitted the corrected\ndocuments package to the Committee.<\/p>\n\n\n\n<p>The\nCommittee, having examined the documents presented by the Organization recorded,\nthat the new oral announcement of the candidate confirmed in notary order is in\na line with the requirements of the oral announcement prescribed by the RA Law\non \u201cNotary\u201d but in the outcomes of the changes, the latter does not meet the\nrequirements mentioned in Paragraph 3 of Annex 1 of the Supreme Judicial\nCouncil decree number 32-\u0546-7, dated June 3 of 2020. <\/p>\n\n\n\n<p>Taking\ninto consideration the circumstance, that the Organization is completely in\ncompliance with the criteria prescribed by the Supreme Judicial Council and is\nconsidered a specialized Organization in the field, as well as taking into\naccount the fact that the candidate meets all the prescribed requirement, on\nJuly 10 of 2020 the Organization filed an appeal to the Competitive Committee\nwith the demand to review the application of the Organization prioritizing the\nsatisfaction of content related requirements and refraining from abusing the\nartificial requirements. <\/p>\n\n\n\n<p>Based\non the presented appeal, in the scope of the instituted proceeding the\nCommittee held a hearing on July 15 of 2020 and the President of the\nOrganization and the nominated candidate participated in the mentioned meeting.\n<\/p>\n\n\n\n<p>In\nthe outcomes of the presented appeal and the hearing held in that regard, the\nCommittee decided to reject the appeal submitted by the President of the\nOrganization and remain the decision adopted on 06.07.2020 unchanged. <\/p>\n\n\n\n<p><strong>Appeal in Judicial Order<\/strong><\/p>\n\n\n\n<p>On\nJune 23 of 2020, the President of the Organization filed appeals to the RA\nAdministrative Court, with the demand to: <\/p>\n\n\n\n<ul>\n<li>Oblige\nthe Committee to satisfy the application filed to the Competitive Committee and\nto submit &nbsp;the appeal of the Organization\nto the RA General Assembly of Judges&nbsp; <\/li>\n\n\n\n<li>Oblige\nthe Committee to adopt a decision on presenting the nomination of the\nOrganization\u2019s non-judge member to the RA General Assembly of Judges. <\/li>\n<\/ul>\n\n\n\n<p>At\nthe same time, interventions on ensuring the implementation of the appeal were\nmade. <\/p>\n\n\n\n<p>By\nthe case number \u054e\u0534\/4527\/05\/20,\ndated July 24 of 2020, the RA Administrative Court adopted a decision to accept\nthe appeal filed by the Organization against the Competition Committee on the\nElection of Non-Judge Member the Ethics and Disciplinary Commission of the RA\nGeneral Assembly of Judges on the demand to oblige the RA General Assembly of\nJudges to present the nomination of Hasmik Harutyunyan\u2019s candidacy as a\nNon-Judge Member the Ethics and Disciplinary Commission to the RA General\nAssembly of Judges into proceeding. <\/p>\n\n\n\n<p>On\nJuly 28 of 2020, the RA Administrative Court adopted a decision to satisfy the\nintervention presented as a means to ensure the appeal, according to which the\nCourt obliges the Competition Committee to adopt a decision on the presentation\nof Hasmik Harutyunyan\u2019s candidacy nomination as a non-judge member of the\nEthics and Disciplinary Commission to the RA General Assembly of Judges. <\/p>\n\n\n\n<p>By\nthe outcomes of the RA General Assembly of Judges\u2019 votes, the non-judge members\nof the Ethics and Disciplinary Commission were elected Syuzanna Soghomonyan,\nDavid Hakobyan and as judge member Elizaveta Danielyan, Sergey Marabyan, Arman\nHovhannisyan, Hovik Shahnazaryan, Meri Hambardzumyan, Lilit Katvalyan\nrespectively were elected. <\/p>\n\n\n\n<p>We\ninform, that the process, organization order and the election results of the\ncompetition are continuously examined by the Organization, in regard to which\nnew demands and appeal parallel to the judicial case will be presented. <\/p>\n\n\n\n<p>The\nOrganization will issue announcements on the additional information related to\nthe judicial procedure. <\/p>\n\n\n","protected":false},"excerpt":{"rendered":"<p>On June 18 of 2020, information on announcing a competition to engage candidates for the position of the non-judge member for the Ethics and Disciplinary Commission of the General Assembly of Judges was published at the official webpage of the RA Judicial Department.
