On July 07 of 2021, the RA Court\nof Cassation adopted a decision to reject the cassation appeal against the\ndecision made by the RA Administrative Court dated 23.03.2021 filed by\n\u201cNubarashen\u201d Penitentiary Institution with the demand to recognize the activities\nof Hasmik Harutyunyan against the official of \u201cNubarashen\u201d penitentiary\ninstitution dated 02 of 2017 illegal. <\/p>\n\n\n\n
According to the RA Court of\nCassation, the justifications presented in the appeal are insufficient to\nconsider the existence of the violation of the substantive law and based on the\nlatter the violation of the main essence of the justice conditioned by that\nviolation as grounded. <\/p>\n\n\n\n
On March 25 of 2021, the RA Court\nof Appeal adopted a decision to reject the appeal filed by \u201cNubarashen\u201d\nPenitentiary Institution under the RA Ministry of Justice <\/p>\n\n\n\n
According to the RA Court of\nAppeal, the RA Administrative Court, in a line with the requirements of the RA\nAdministrative Procedure Code, by conducting a comprehensive, complete and\nobjective examination and evaluating the whole evidence available in the case,\nas well as by applying the relevant legal acts towards the later, came to a\nright conclusion and the grounds and justification of the appeals cannot be\nconsidered a ground to satisfy the appeal, therefore for overturning the\ndecision of the RA Administrative Court dated 19.09.2019. <\/p>\n\n\n\n
It should be mentioned, that on\nJanuary 24 of 2019, H. Harutyunyan filed an appeal to the RA Administrative\nCourt with the demand to recognize the activities of the penitentiary institution\u2019s\nemployees illegal. <\/p>\n\n\n\n
The RA Administrative Court recognized\nthe activities of the penitentiary institution\u2019s employees illegal dated April\n02 of 2017 illegal. <\/p>\n\n\n\n
Particularly, it was recorded by\nthe adopted decision, that in the outcomes of the administrative body\u2019s activities\nthe authorities of the member of Public Monitoring Group prescribed by the RA\nMinister of Justice Decree number \u0554\u0540-66-\u0546 were restricted. <\/p>\n\n\n\n
The Court, satisfying the appeal,\nmentioned, that according to the certificate number 22 issued by the Group of\nPublic Monitors Implementing Supervision over the Criminal-Executive\nInstitutions and Bodies of the Ministry of Justice of RA, Hasmik Harutyunyan is\nconsidered a member of the Monitoring Group, who, in a line with the RA\nMinister of Justice Decree number \u0554\u0540-66-\u0546, dated 18.11.2005 can visit\npenitentiary institution any day (including also non-working days) and carry\nout her professional activities as a member of the Monitoring Group, but as a result\nof complain of the above mentioned justification, the Court find, that the\nmembers of the Monitoring Group did not have an opportunity to carry out their\nprofessional activities, as prescribed by the decree, therefore the above\nmentioned facts reaffirm the circumstance, the activities of the administrative\nbody were illegal. <\/p>\n\n\n\n
On April 02 of 2017, the professional\nactivities of Hasmik Harutyunyan, lawyer of \u201cProtection of Rights without\nBorders\u201d NGO and a member of the Group of Public Monitors Implementing\nSupervision over the Criminal-Executive Institutions and Bodies of the Ministry\nof Justice of RA were hindered in \u201cNubarashen\u201d and \u201cKentron\u201d penitentiary\ninstitutions respectively.<\/p>\n\n\n\n
As a justification for hindering\nthe professional activities of Hasmik Harutyunyan it was mentioned that the\nmonitors should have passed the through the election zone to which they did not\nhave access.<\/p>\n\n\n","protected":false},"excerpt":{"rendered":"
