Opinion of the draft law on “Non-Governmental Organizations”

The draft document was elaborated by the “Protection of Rights without Borders” NGO.

The current opinion is given in regard to the RA Draft Law on “Non-governmental organizations” published on the official website of the RA Ministry of Justice on November 18 of 2014.

By the current, the regulations of Articles 13, 23, 25, 26 and 30 of the draft law (as well as the RA Law on “Making Amendments and Supplements to the RA Law on Administrative Offences”, RA Law on “Making Amendments on the RA Law on “Public and Private Notification on Internet”) in a line with international standards and principals regarding were evaluated.

The presented summery is based on the answers given to the following questions.

  • Whether the regulation stipulated by the law are in a line with the regulations of the law
  • Whether the stipulated intervention is necessary and does not set impose excessive restriction for the functioning of the non-governmental organizations.
  • Whether the stipulated intervention is necessary and does not set impose excessive restriction for the functioning of the non-governmental organizations and does not lead to discriminatory attitude by the state.

Opinion on the draft RA Law on “Non-governmental organizations”
